AIT provides you with access to live / online courses, trading products and tools, 1 on 1 coaching, webinars, monthly accountability and progress tracking sessions offline at location or online via internet, e-books, discussion groups and communities on other social platforms (incl. Whatsapp, Discord), content on social media channels (Instagram, Facebook, Youtube, Linkedin, Twitter, TikTok, Discord, Threads etc), tools and materials for marketing, educational and informational purposes only (collectively, including any new features, the “Service”) through our website located at domains www.instituteoftrading.net, www.ait.amsterdam (including any sub-domains therein, such as store.[domain] and video.[domain]) (the “Site”), subject to the terms of service herein (the “Terms and Conditions”) , which also comprises the "Risk and Legal Disclaimer" (available at www.instituteoftrading.net/disclaimer)

Every student, customer, registered user, visitor acknowledges that he/she has read, understood and agreed to abide the full Terms and Conditions (as outlined below).
1. Student Warranties & Requirements
a. The student warrants that all documents and information supplied are true, authentic and correct.
b. In cases where a student has provided incorrect, fraudulent or misleading information, they will be immediately removed from the course and no fees will be refunded.
c. Student Requirements for courses
i. -> A lot of motivation to learn and then to practice on your own time, completing homework assignments
ii.-> We strongly recommend having a second display/monitor connected to your laptop, or 2 displays to your desktop PC during the masterclasses. This to allow an optimal view of the course material but also practicing yourself in the same time with the instructor
iii.-> Microsoft Windows 10 or 11 Operating System is recommended, for best use of the Forex Tester trading simulator
*If you have a MacBook, a solution for that would be to create a virtual machine with Parallels Desktop or VMWare Fusion and install Windows on it. It is your responsibility as student to arrange that prior to the course.

Please note that Forex Tester program isn’t compatible with Play on Mac, VirtualBox on Mac, and Wine.
2. Code of Conduct
Students are expected to act in a professional and respectful way with all staff, other students, members of the public and AIT Property. Violations of the student code of conduct may result in severe disciplinary action such as course expulsion. We take this matter very seriously and expect all students to adhere to the standards set forth for conduct within this institute.
3. Withdrawal
a. The student agreeas that any changes, deferrals, or withdrawals must be approved by AIT prior to taking effect. If a student fails to participate to their course as scheduled without notifying AIT beforehand, they will be expelled and receive no refund.
b. AIT reserves the right to pursue any outstanding fees from students who have withdrawn from the program without prior consent.
4. Exclusion
To the extent permitted by law, we, other members of our group of companies and associated parties exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
5. Registration on Course
By registering for a course program, students will become members of AIT and agree to uphold its Code of Conduct (clause 2) and Terms and Conditions of registration.
* By 'lifetime access' to Video Courses, we are referring to the operational lifetime of the current software platform where the course is being hosted. If this platform ceases to function, AIT will make reasonable efforts to migrate content to a new platform, but continuity is not guaranteed. In the unlikely event that the hosting platform will not perform anymore due to cases outside our power, the students might lose access to the course contents.
6. Refund Policy - Student Default
a. A student has the right to a full refund, minus a 20% processing fee, when withdrawing from one of our live courses 30 days or more prior to the start of the LIVE program. All refunds will be finalized within 45 days of the initial claim.
b. Students who withdraw from a Live course up to 29 days prior to the start of the program will be entitled to a 50% refund.
c. Students who withdraw after commencing date of the Live course are not eligible to receive a refund. Delegates must make all tuition payments according to the instalment plans outlined in their enrolment form, once they have commenced their program.
d. When a student defers their course, they forfeit their right to obtain a refund. Likewise, when a student fails or tries to withdraw from the deferred course, refunds may not be issued except in extraordinary cases. The Refunds Committee shall assess individual circumstances and have the sole discretion in determining whether or not those conditions are exceptional.
e. Any refunds awarded in respect of this clause will be processed within 45 days of the claim.
f. If a refund is applicable, a credit invoice will be issued. Any refund made by AIT will be paid to the original payor.
g. Notice of cancellation must be sent in writing (via email) to AIT. Verbal notice will not be considered a cancellation.
h. Substitution of participation is possible (as long as the substitute fits the applicable profile), and must also be requested in writing, with the full contact details of the new registrant. AIT must be notified in writing at least 48 hours prior to the start of the program. When a substitution of participation is approved, no refunds will be issued.
i. Some of our courses tuition include a license for Forex Tester software, this is provided by an external software company (ForexTester.com). If this license has been allocated already to the student, and the student applies for a course tuition refund, then we have the right to substract and keep the license price corresponding to the Forex Tester basic version software (approx. 180 Euro, or at market price at that time).
k. We have a No Refunds policy for our Community Services on Discord Elite channels, Digital products such as our eBooks or Video on demand content on store.[domain] and video.[domain].
l. In the event of significant technical disruptions caused by AIT that prevent course completion, students may request a proportional refund, which will be evaluated on a case-by-case basis.
7.1 Coaching Terms of Service
Disclaimer: payment for consultations are based on time and time alone. Payment is not based on content or context of said meeting. Client is responsible for any questions asked, etc. to ensure they achieve desired use of time, AIT trainer will strive to provide requested information, but makes no guarantees that a solution will be reached in one scheduled meeting.
m. CANCELLATION & REFUND POLICY for Coaching services

If you are in need of rescheduling, please contact me 48 hours (2 days) or more before our meeting. If a full cancellation is required, please contact me 72 hours (3 days) or more before our meeting and allow 24 Hours or more for notification.

There will be no refunds provided on scheduled meetings where clients are a no-show. The consultation window (using Teams/GoogleMeet etc) will be open during clients scheduled time frame where the service provider, AIT trainer, will be in attendance. If client is a no-show or has not given a 48 hour notice for re-scheduling or cancellation, then a refund for the 60 minute time frame will not be granted.

Client is responsible for paying another consultation session if the initial meeting is missed. The consultation fee is solely based on the time for meeting whether questions get answered or not. Client is paying for the time, not content or context of the meeting.
7.2 Other General Conditions
a. AIT reserves the right to deny program admission to an applicant if we deem that they lack the necessary qualifications or experience needed for the particular program.
b. AIT reserves the right to use its discretion to determine whether to make refunds in particular instances which fall outside paragraph 6 above.
c. In the event of unforeseen circumstances, such as a low number of participants, AIT reserves the right to cancel a program. Reimbursement for program fees will be made available in these cases; however AIT cannot take on any financial obligation with regard to travel, accommodation or other costs related to the cancelled program or event, where and if applicable.
d. AIT is committed to providing its participants with excellent service; however, the liability of AIT for losses caused by its negligence, breach of contract, or any other reason will be capped at the full amount(s) paid by participant(s) for relevant program(s) and/or materials.
e. Regarding the upgraded version of products where "[X] Months of Personal Technical & Mindset Guidance" (X=a number) is included, to be understood that it will be capped to a maximum of 1Hour per week of 1-on-1 session, where the Student gets to ask Questions from his/her weekly trading journey and we go through the eventual trading results, homework tasks and mindset points of the Student together. If no questions are due for discussion from Student's side, then this time can be used by the Student to practice trading and improve his/her trading skills.
f. Site and Service Content are not meant for individuals under the age of 18.
8. Force majeure
Amsterdam Institute of Trading (AIT) shall not be liable to the student or be deemed to be in breach of its agreement to provide any of their service/products to the student by reason of any delay in performing, or any failure to perform, any of AIT's obligations, if the delay or failure is due to any cause beyond AIT's reasonable control. Causes beyond AIT's reasonable control shall include but are not limited to:

the non-availability (including due to sickness, injury, or death) of any person employed or engaged by AIT to deliver the services who cannot by the exercise of reasonable endeavors be replaced or substituted;

events or circumstances that cause any premises where the trading course or coaching is to be delivered to be unavailable, if suitable alternative premises cannot by the exercise of reasonable endeavors be found;
-
the course or coaching being terminated prior to its scheduled conclusion (e.g. due to security evacuation, fire evacuation);
-
failure of power, internet connection, or the student's system in the case of remote delivery of the course or coaching.

this also includes pandemics, economic collapses, and geopolitical crises impacting service delivery.
In such circumstances, AIT may extend the time for performance of its obligations so affected, and if the cause continues for longer than 30 days or the force majeure is found to be permanent, AIT's agreement (the course, the coaching sessions) with its participants for the relevant program(s) will be terminated without liability to the student.
AIT strictly adheres to its policies and reserves the right to cancel, change, reschedule, relocate or suspend (the execution of) any program in cases of force majeure.
9. Community Responsibility Clause, Data Protection, Assets created and opinions shared and
Your enrolment on a course of study requires sharing of personal information about you (including “Sensitive Personal Information”). You give your express permission for the sharing of information for the purposes of managing your application, enrolment, academic achievement, fees management and related activities. All information will be held and processed in accordance with the requirements of the Data Protection Act.
By enrolling in a course, you are granting us permission to collect personal information about you (including “Sensitive Personal Information”). You give your express permission to share this data for purposes of managing your application, enrolment, academic progress, fees payment and other related activities of which will be done as per the Data Protection Act guidelines.
Privacy Community Groups such as WhatsApp: Please note that members' phone numbers may be visible to other members for seamless communication within the group. By participating in AIT's WhatsApp, Discord, or other group platforms, users consent to limited visibility of their contact information (e.g., phone number) by other members. AIT is not liable for how this information is used by group participants.
AIT reserves the right to remove participants from community groups (e.g., WhatsApp, Discord) for inappropriate behavior, spamming, or sharing unauthorized third-party materials.
9.1 Terms and Conditions for The assets created and opinions shared
The assets created and opinions shared are made available for (company) use globally and for perpetuity.
By submitting a review/testimonial on any reviews platform on the world wide web about AIT, you agree that the content created and opinions shared are made available for use by The Institute of Trading (AIT) globally and for perpetuity. This includes the right to publish, distribute, and utilize the review in promotional materials, press releases, and other marketing channels.
Some Live Courses or FREE Webinars sessions where you participate may be recorded and portions and/or the full length of the recording may be used to improve and extend our range of products, to provide an as-close to real learning experience for students such as On Demand (recorded) Video Courses, or to be distributed to students who were unable to participate to the Live session; we are doing our best to protect your full name and face , but they still may pop-up in some recordings, conversations, including your voice. By participating to the Live or Free sessions you confirm that you agree with this. 10. Confidentiality
You shall not, except as authorised by AIT, divulge to any persons, firm, company or other organisation whatsoever at any time any confidential information belonging to AIT or relating to its affairs or dealings which may come to your knowledge during your association with AIT. All papers and digital files, software EAs and templates are considered to be confidential, together with any copies or extracts thereof, made or acquired by you in the course of your time with AIT.
11. Disclaimers
11.1. Investments

At the Amsterdam Institute of Trading, we use enthusiastic and motivational language in our product descriptions and promotional materials to illustrate the potential benefits and outcomes of our courses, indicators, and coaching services. 12.3 Educational Use of Test-Net Tokens used during crypto/blockchain educational products / services
Purpose of Tokens
The tokens distributed during the course are created on a test network (test-net) and are intended solely for educational and demonstrative purposes as part of a crypto or blockchain-related educational program. These programs may include, but are not limited to:

The fee does not constitute payment for the acquisition of tokens, and the tokens are not sold, traded, or offered as investment assets.

Non-Investment Nature of Tokens

The tokens are not designed, promoted, or intended for investment purposes.

They do not confer any financial rights, ownership, or economic benefits to participants.

Prohibition on Selling Tokens

Participants are strictly prohibited from selling, trading, or exchanging the tokens for money or any other form of compensation.

If a participant engages in such activities, AIT, its partners, collaborators, and affiliates are not liable or responsible for any consequences, including but not limited to financial losses, legal issues, or regulatory actions.

Test-Net Environment

All activities involving tokens are conducted in a simulated test-net environment and do not involve real cryptocurrencies or financial risks.

Participants acknowledge that all transactions are simulated and agree to use the tokens strictly as guided during the course.

Liability Disclaimer

AIT is not responsible for any misinterpretation of the purpose or use of the tokens.

Participants agree to use the tokens solely for educational purposes and in accordance with the course guidelines.

Regulatory Compliance

The tokens distributed during the course are not classified as "crypto-assets" under the Markets in Crypto-Assets Regulation (MiCA), as they are not intended for economic use, payment, or investment purposes.

AIT ensures that the tokens comply with applicable regulations and are used exclusively in an educational context.

13. Intellectual Property Rights
Any unauthorized recording, copying, distribution, or transmission of our courses, whether live or video on demand, will result in a penalty of €500,000 (five hundred thousand euro). Unauthorized use of AIT trademarks, logos, slogans, or proprietary materials will result in legal action, with penalties as determined under Dutch law, including but not limited to fines starting at €500,000 (five hundred thousand euro). This penalty is enforceable in addition to any other legal remedies available to The Institute of Trading under applicable law.
13.1. Site and Service Content, Software and Trademarks
You acknowledge and agree that the Site and Service contain content or features (the “Content”) that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorised by us, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Site, Service or Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you legally upload to the Site or Service.
In connection with your use of the Site and/or Service, you agree that you shall not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods.
If you are blocked by us from accessing the Site or Service (including but not limited to blocking your Internet Protocol (“IP”) address), which may be done at our sole discretion for any reason whatsoever, you agree not to implement any measures to circumvent such blocking (e.g. by masking your IP address or using a proxy IP address). Any use of the Site, Service or Content other than as specifically authorised herein is strictly prohibited.
The technology and software underlying the Site and/or Service or distributed in connection therewith are the property of us, our affiliates and/or our partners (where applicable) (the “Software”). Under no circumstances will we be liable in any way for (a) any content or materials of any third parties (including users), including but not limited to any errors or omissions in any content, or (b) any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that we do not pre-screen content, but we and our designees will have the right (but not the obligation) at our sole discretion to refuse or remove any content that violates these Terms and Conditions or is deemed by us, at our sole discretion, to be otherwise objectionable. 13.3. User Content Transmitted Through the Service
With respect to the content or other materials you upload through the Service or share with other users or recipients (collectively, the “User Content”), you represent and warrant that you own all right, title, interest in and to such User Content, including, without limitation, all copyrights and rights of publicity contained therein, and that you have all required rights to post or transmit such content or other materials without violation of any third-party rights. By uploading any User Content you hereby grant and will grant us, our affiliated companies and partners a non-exclusive, worldwide, royalty free, fully paid up transferable, sub-licensable, perpetual, irrevocable licence to copy, display, upload, adapt, perform, publish, distribute (through multiple tiers of distribution and partnerships), store, modify and otherwise use and fully exploit your User Content in any and all media, form, medium, technology or distribution methods now known or later developed and for any and all purposes (commercial or otherwise).
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information relevant to the Service (“Submissions”), provided by you to us, our affiliated companies or partners are non-confidential and we, our affiliated companies and partners will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you.
You acknowledge and agree that we may (but are under no obligation to) preserve content and may also disclose content if required to do so by law or in good faith that such preservation or disclosure is reasonably necessary to:
i. comply with legal process, applicable laws or government requests;
ii. enforce these Terms and Conditions;
iii. (respond to claims that any content violates the rights of third parties; and/or

The Amsterdam Institute of Trading (“AIT”) Affiliate and Refer-a-Friend Scheme is a program designed to financially reward individuals who introduce their friends to AIT courses. In order to be eligible for the rewards, all the Terms and Conditions below must be met:

- To qualify for the free course, both referred friends must complete their enrollment and payment for the selected course.
- The free course will be granted to the referrer only after the referred friends have fully paid and commenced their course.
18.3. Refund Policy:
- The referred friends must commit to their course enrollment and are not eligible for refunds. By participating in this program, referred friends acknowledge and agree to this no-refund policy.
- In the event that a referred friend requests a refund or cancels their enrollment, the referrer will no longer be eligible for the free course unless another friend enrolls and completes the payment.
18.4. Form Submission:

19.2. Joining the Program
19.2.1 Eligibility: To join the Program, you must be at least 18 years old. We reserve the right to accept or reject any affiliate application at our discretion.

19.3. Affiliate Responsibilities

Affiliates engaging in fraudulent activity, including false advertising, misrepresentation of AIT services, or spamming, will be disqualified immediately, with commissions forfeited.
19.3.2 Prohibited Activities: Affiliates are prohibited from engaging in any deceptive, misleading, or unethical practices, including but not limited to spamming, false advertising, and using unauthorized promotional codes.
19.3.3 Affiliate Links: Affiliates must use the unique tracking links provided by GoAffPro. These links track customer referrals and ensure you receive credit for qualifying purchases.
19.4. Commission Structure
19.4.1 Commission Rates: Affiliates can earn up to 15% commission on qualifying purchases made through their affiliate links. The exact commission rate may vary depending on the product and any promotional campaigns.
19.4.2 Referral Discount: In addition to earning commissions, the referrer is also eligible to receive a discount on their own purchases. The current discount rate is 10%, but this rate may change at any time at the discretion of the Institute of Trading. Affiliates will be informed of any changes to the discount rate.
19.4.3 Qualifying Purchases: Commissions and referral discounts are earned on successful referrals for qualifying purchases. A "qualifying purchase" is a purchase made by a referred customer that meets the following criteria:
The purchase was made using the affiliate’s unique tracking link.
The purchase was not refunded, canceled, or charged back.
19.4.4 Payouts: Commissions are paid out on a monthly basis, provided the affiliate has met the minimum payout threshold of €50. If the threshold is not met, commissions will be rolled over to the next month. Affiliates are responsible for providing accurate payment information.
19.5. Termination
19.5.1 Termination by Affiliate: Affiliates may terminate their participation in the Program at any time by providing written notice to the Institute of Trading.
19.5.2 Termination by Institute of Trading: We reserve the right to terminate any affiliate's participation in the Program at our discretion, without notice, if the affiliate is found to be in violation of these Terms.
